1. Introduction

Welcome to Escapi (“Escapi,” “Company,” “we,” “our,” “us”)! Please take a moment to carefully read through our Terms of Service. These Terms of Service (“Terms,” “Terms of Use”) govern your use of our web pages and mobile application Escapi (collectively, “Service”) operated by Escapi.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Agreements. 2. License Grant

Escapi grants you a non-exclusive, non-transferable, limited license to access and use the Service for personal, non-commercial purposes in accordance with these Terms. This license does not grant you any ownership rights in the Service, and you agree not to copy, modify, distribute, sell, or lease any part of our software or services, nor to reverse engineer or attempt to extract the source code of the software.

3. Communications

By creating an account on Escapi, you agree to subscribe to newsletters, marketing materials, and other information we may send. However, you may opt out at any time by following the unsubscribe link or by emailing us at contact@escapi.com.au.

4. Purchases

To make purchases through Escapi, you may be required to provide relevant information, including payment details. By making a purchase, you confirm that you have the legal right to use the payment method provided. We may use third-party services to facilitate payment processing. By submitting payment information, you authorize us to share necessary details with third parties, subject to our Privacy Policy.

We reserve the right to refuse or cancel any order if fraudulent or unauthorized activity is suspected.

5. Subscriptions

Certain features of Escapi are billed on a subscription basis (“Subscription(s)”). Billing cycles are set monthly or annually, based on your selection.

Your Subscription will automatically renew at the end of each billing cycle unless canceled through your account settings or by contacting contact@escapi.com.au. A valid payment method is required for automatic billing. If automatic billing fails, we may issue an invoice for manual payment.

6. Free Trial

We may offer a Subscription with a free trial. If you provide billing information when signing up, you won’t be charged until the trial ends. On the last day of the trial, unless canceled, you’ll be charged for your selected Subscription.

7. Fee Changes

Escapi reserves the right to modify Subscription fees, which will take effect at the end of the current billing cycle. We will notify you of any fee changes, allowing time for you to cancel if desired.

8. Refunds

Unless required by law, paid Subscription fees are non-refundable.

9. Content

You are responsible for any content you post on Escapi. By posting, you represent that you own or have the right to use the content and grant us permission to use it on our Service.

We reserve the right to remove content that we deem objectionable, including discriminatory or violent content, overtly sexual or misleading information, or content that violates privacy rights.

10. Prohibited Uses

You may only use Escapi for lawful purposes. You agree not to use Escapi to:

Violate any laws or regulations.
Exploit or harm minors.
Send unsolicited promotional material (“spam”).
Impersonate Escapi or others.
Infringe on others’ rights or engage in illegal, harmful, or fraudulent activity.

You also agree not to interfere with or disrupt the Service, introduce malicious code, or engage in any activity that might harm or undermine Escapi’s operations or reputation.

11. Termination

We reserve the right to terminate or suspend your account and access to the Service at our discretion, without prior notice, if you violate these Terms. Upon termination, your right to use the Service will immediately cease, and all provisions of these Terms will remain in effect, including ownership, warranty disclaimers, and limitations of liability.

12. External Services

Our Service may contain links to third-party websites or services that are not owned or controlled by Escapi. Escapi has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Escapi shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any third-party websites or services.

We advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit or use.

13. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Escapi, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your content.

14. Warranty Disclaimer

Escapi provides the Service on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Escapi makes no warranty that (i) the Service will function uninterrupted, secure, or available at any particular time or location; (ii) any errors or defects will be corrected; (iii) the Service is free of viruses or other harmful components; or (iv) the results of using the Service will meet your requirements.

15. No Use By Minors

Escapi is intended for users aged 18 and older. By accessing Escapi, you confirm that you are at least 18 years old.

16. Accounts

When creating an account, you guarantee that the information provided is accurate. You are responsible for the security of your account credentials. Any activity under your account is your responsibility, and you must notify us of any unauthorized access immediately.

We reserve the right to terminate accounts for violations of these Terms.

17. Intellectual Property

Escapi, including its content and features, is the property of Escapi. You may not use Escapi’s content for commercial purposes without prior written consent from us.

18. Error Reporting and Feedback

If you have feedback or suggestions, please contact us at contact@escapi.com.au. By submitting feedback, you acknowledge that Escapi may use it without restrictions.

Escapi may contain links to third-party websites. We are not responsible for the content, policies, or practices of these third parties.

20. Account Deletion

If you wish to delete your Escapi account and all associated data, you can do so directly within the Escapi app:

Open the Escapi app.
Go to Settings.
Tap on Delete Account and follow the on-screen prompts.

Data Deletion Details:

Upon account deletion, your profile information, group memberships, and associated expenses will be permanently deleted.
Some data, such as financial transactions or legal records, may be retained for compliance with legal obligations..

21. Dispute Resolution

If you have any dispute regarding our Service, please contact us first to resolve the issue informally at contact@escapi.com.au. If a formal legal resolution is required, the governing law and jurisdiction will be in accordance with the laws of Australia.
